To permit or not permit, that is the question. Here are suggestions to help guide you through the convoluted permit maze process.

If you are a personal chef and cook meals at your clients home, you do not need a permit nor need to use a licensed commercial kitchen.

If you plan on selling your product retail (no resale) and the place or client that you are selling to does not have a permit to sell food, you will be required to obtain a permit from the San Mateo Environmental Health Department and use a licensed commercial kitchen to prepare and cook your product. You cannot use your kitchen at home. The most common permits offered are a catering permit will allow you to sell your food, farmer's market permit to sell at farmer's markets, and mobile food catering permit to sell on a mobile food truck.

If you plan to sell your product to a business wholesale, on the Internet (ecommerce), in the state of California, you will need to get a permit from the California Department of Public Health.

First Steps
  1. Create the name of your company and secure a domain name.
  2. File for a Fictitious Business Name with the County of San Mateo County Clerk. For more information, visit the site.
  3. Apply for a business license from the city you live in.
  4. Contact the San Mateo County Environmental Health Department for a permit for catering, farmers market, or mobile food truck. Find out more...
